You may remember the bad truck accident in New Jersey involving the comedian, Tracy Morgan. As you will recall, there has been a lot of news lately surrounding this terrible accident that occurred when the driver of a semi truck plowed into the back of the vehicle the comedian was riding in. Tragically, another comedian in the limo, James McNair (a/k/a Jimmy Mac) had his life cut tragically short, as a result of the crash.  Mr. McNair’s children received a $10,000,000 settlement for his wrongful death.

People are asking how it is that Wal-Mart can place blame on Tracy Morgan since he is considered a victim in this unfortunate incident. It appears that Wal-Mart is attempting to minimize their responsibility by claiming if Tracy Morgan would have worn a seatbelt he would not have been injured, or at least, not as badly injured during the crash. Insurance carriers often try to place partial blame on the victim of the accident for not using a seatbelt. That’s why you need an experienced Personal Injury specialist on your side, fighting for you. For instance, in Mr. Morgan’s case, he may have been just as severely injured even if he were wearing a seatbelt.

The truck that hit Tracy Morgan is owned by a large well-known company.  The questions many people ask during this time is how much did the company know about their employee who was driving the semi-truck? Had the employee been driving too many hours, was on his cell phone, was he under the influence of drugs or alcohol, did he have a medical emergency, or fall asleep? As you can imagine, anytime a crash occurs, especially when a crash results in a death, there are certain laws and procedures that must be followed, and it takes some time for all of the details to come out, and for the homicide investigation to be completed. Sometimes, people believe that in these kinds of circumstances, when they are waiting for reports to be completed by the investigating agencies, they do not need to consult with an attorney right away. However, the opposite is true. Especially in cases involving commercial vehicles or semi-trucks, you should act quickly to consult with an attorney, so that you know your rights, and so your attorney can work to be sure that all the evidence is preserved. You can be sure that the big corporations and trucking companies have attorneys working for them, and you should have an experienced legal team on your side.

Our office has handled numerous cases involving semi-trucks causing accidents involving people from our very own community who were dearly loved, and whose lives were just as important, and they were treated the same way as Mr. Morgan: they were made to feel that they were at fault when it was actually the semi driver who was at fault.

We know from experience, that it is very important to retain legal counsel as soon as possible, before valuable evidence is lost or destroyed. If you or someone you care about has been injured as a result of a semi truck’s negligence, call our office 24/7, toll free, at 1-800-800-2575 for a free consultation.
